There is a letter leaked on the conditions for the US help to Ukraine
It is well-meant, in theory, if one ignores the war
Conditions aim to bolster Ukraine's resilience and EU integration capacity. But the list is a kitchen sink and isn’t realistic. Decide for yourself 1/
1. By A pril 1, 2024 for Ukraine to adopt procedures on trading transparency in wholesale energy markets
2. Reform goals for state firms' supervisory boards, including Ukrenergo, Naftogaz, Energoatom, GTSO. Align with OECD corporate governance standards 2/
3. Strengthen Special Anti-Corruption Prosecutor's Office (SAPO) via selection process changes, accountability
4. Also bolster SAPO's independence over cases, provide separate extradition authority
5. National Anti-Corruption Bureau - add detectives, forensics, oversight 3/
6. Reinstate asset declaration requirements for officials/judges. Restore political party financial disclosures. Simplify system
7. Restart judicial selection under reformed High Qualification Commission of Judges. Fill ~2,000 vacancies via transparent process 4/
8. Strengthen Asset Recovery and Management Agency (ARMA). Open competition for leadership, improve transparency and effectiveness
9. Reform Supreme Court. Review integrity after corruption scandals. Select new justices transparently with independent experts' input 5/
10. Establish High Administrative Court for cases against state agencies, properly vetted judges. Dissolve corrupt Kyiv District Admin Court
11. Expand High Anti-Corruption Court. Allow some cases to be heard by single judge, not just panels of three. Handle growing caseload 6/
12. Set updated merger review and anticompetitive inspection procedures for Antimonopoly Committee by 2024
13. mplement gas/electricity price liberalization roadmap. Develop social protections as prices increase. Ready energy grid for EU integration 7/
14. Strengthen Accounting Chamber and State Audit Service independence and professionalism for reconstruction oversight
15. Reform Ministry of Defense (MOD) to align military procurement and planning with NATO standards of transparency and accountability 8/
16. Adopt law #4210 bolstering civilian control/oversight of military, transforming governance per NATO principles
17. Invest in women's participation in security (Women, Peace and Security initiative) 9/
Now, that for the next 10 month, basically this winter, with the blackouts, missiles, counteroffensive, migration, and all human capital diverted to the war effort.
It feels that every department in the US put in all their wishes, but without any coordination 10/
Or reflection on feasibility.
All of these reforms are needed, but they take years if not decades even in the most advanced economies with great state capacity.
Demanding these reforms to be implemented over the winter is setting up everyone for failure.
